Mawi fails to strike out suit

KUALA LUMPUR: Singer Mawi failed in his bid to strike out a suit against his mineral water company.

High Court senior assistant registrar Noorasyikin Sahat dismissed with costs the application by Mawi World Sdn Bhd, of which the 27-year-old Akademi Fantasia 3 sensation is a director.

That means the suit filed by mineral water company Yassa Sdn Bhd in October 2006 will proceed. However, no hearing dates have been fixed yet.

In the RM1mil suit, Yassa claimed Mawi World had infringed the copyright of its products.

Yassa wants Mawi World to stop producing bottled mineral water using Yassa’s licence number, factory address and product contents on its label.

Mawi, in his affidavit to strike out the suit, said Yassa’s action against his company was frivolous and an abuse of the court process.

The singer, whose real name is Asmawi Ani, claimed that Yassa’s action was without basis as there was no infringement of copyright.

“I have been advised that if the plaintiff wants to take action, it should be against the supplier of our bottled mineral water, Johtaw Corporation (M) Sdn Bhd,” he said in the affidavit last year.
